The losses attributed to Fire and its Allied Perils in Public Buildings are enormous and cause great concern, hence the inclusion of provisions of section 65 of 2003 Insurance act by the Federal Government.
INSURANCE OF PUBLIC BUILDINGS:
Section 65 of 2003 Insurance Act makes it mandatory for every public building to be insured with registered insurer against the hazard of collapse, fire earthquakes, storm and flood.
The insurance policy under the provision shall cover legal liabilities of an owner or Occupier of premises in respect of loss or death suffered by any user of the premises.
An occupier or owner of premises who fails to insure his premises as required by the provision commits an offence and is liable on conviction to a fine of not more than #250,000.00 or imprisonment for one year or both
WHAT ARE PUBLIC BUILDING
A Public building refers to any building which members of the public shave right of access.
B A tenancy include all rented houses or apartments
C Hostel – Which include university hostel, dormitories in tertiary institutions and other institutions of learning, hostels of private organizations like those of YWCA’s club houses etc
D Lodger or license include hotels, guesthouses or any temporary accommodation
E Any buildings to which members of the public have free access for the purpose of obtaining:
- Education services, school, seminaries, colleges, universities and other institution of learning etc.
- Medical services-hospital, maternity centers medical centers, pharmacies and dispensaries etc.
- Recreational services- resorts, clubs amusement parks, fitness centers, zoological gardens, cyber cafés, museums etc.
- Places of transaction of businesses-toll plaza, registered companies, offices,
Business centers, supermarkets, stores, and all other business out fit open to the Public.
Document required from the claimants when making claims under this Insurance Policy which could be as a result of injuries sustained or death include the following;
THE INSURANCE OF PUBLIC BUILDINGS COVER
The policy is designed to relief the insured as owner or occupier of premises against any legal liability in respect of accidental bodily or death suffered by any user of the premises as a result of the hazard of collapse, fire, Earthquake, storm, and flood.
This policy provides cover for Accidental damaged to property of the premises as a result of collapse, fire, Earthquake, storm, and flood.
SCOPE OF COVER FOR FIRE AND ALLIED PERILS
This policy provides cover for your physical asset against destruction or
damage caused by the following perils.
- Fire, Lightening, Explosion
- Flood, Storm, Earthquake
- Riot, Strike And Civil Commotion, Bush fire
- Burst pipe, Aircraft damage, Impact damage by any road vehicle or animal
PROPERTIES TO BE COVERED
You are only required to give us the list and corresponding value of assets
under the following headings (where applicable)
- Building including landlord improvements stating each location
(Address).
- Plant and Machinery stating type, model and the location
- Stock and materials in trade
- Office furniture, Equipment and Fixtures/Fittings
- All other contents
